The DEA (United States Drug Enforcement Act) set new laws on their Federal Register Government website at the link here, that effective January 13, 2017 (This Friday!), “an extract containing one or more cannabinoids that has been derived from any plant of the genus Cannabis will be treated as Schedule I controlled substances.”
This means CBD and all other extracts derived from the cannabis plant (psychoactive or not) will come under Schedule 1 drugs, like heroin, LSD, marijuana, and ecstasy, and cannot cross state lines.
If you make your way down this Federal Register Government Announcement, one commenter requested clarification of whether the new drug code will be applicable to cannabidiol (CBD), if it is not combined with cannabinols. The response word for word was:
The DEA’s argument is that the agency is entitled to regulate CBD oil because all extracts contain trace amounts of THC, the active ingredient in cannabis which remains illegal at the federal level. This is so ridiculous, because it’s practically undetectable and the benefits are immense!
The bottom line here is that the DEA is making CBD extracts and oil concentrations illegal and the ban will be effective this Friday! In our experience they can cut our sales of CBD Oil off without warning, which means that ordering can stop point blank or we will face legal prosecution. However, people buying the product before the Friday cut off are allowed to have it in their possession.
The next step is that we are all expecting to get compliance letters next week, then we will have 15 working days of receipt of this letter, to where we will have to notify their office in writing of the specific steps we have taken to correct the violations. There is a possibility that we can still take orders until we receive this letter. However, we will not know until the DEA releases more information this Friday afternoon.
